Attorney General Reaches Settlement with Kootenai County Contractor Over Deceptive Practices

BOISE, ID – Idaho Attorney General Raúl Labrador has announced a legal settlement with Neal R. Foster, a Coeur d’Alene-based contractor operating under the name Prime Builders, following multiple consumer complaints and findings of deceptive construction-related business practices.

The settlement stems from seven complaints submitted to the Attorney General’s Consumer Protection Division, with consumers reporting more than $325,000 in total losses. Customers alleged that Foster accepted payments for construction projects—including home additions, decks, and sheds—that were either never started, left unfinished, or not refunded.

Foster conducted business under the registration of his spouse, Monica R. Foster, and operated in both Idaho and Washington. Under the terms of the settlement, he is prohibited from advertising, negotiating, or entering into construction contracts in Idaho unless working under the direction of a qualified supervisor or third-party who is directly responsible for his actions. The agreement also bars him from using his spouse’s name to conduct business.

“The case is a reminder that Idaho contractors must be held to high standards of honesty and accountability,” said Attorney General Labrador. “Our office will continue to take decisive action against those who take advantage of Idaho families through fraud or deception.”

The court approved the settlement on March 6, 2025. Foster is required to begin restitution payments to affected consumers within 30 days and will follow a court-approved payment plan until all amounts are repaid.

The Attorney General’s Office also shared a list of consumer tips to help Idahoans avoid contractor fraud, including checking Better Business Bureau profiles, verifying insurance, and understanding Idaho Code § 48-525 regarding contractor disclosures.

Consumers who believe they may have been affected by Foster’s practices are encouraged to file a complaint with the Consumer Protection Division. A complaint form is available on the Attorney General’s website.
