LEWISTON, ID – A 28-year-old man was arrested Friday night after allegedly throwing a container of orange juice at a Lewiston police officer and later kicking officers during a struggle to detain him, according to court documents.
Michael Damon, who police say is homeless, faces a felony charge of battery on a law enforcement officer and a misdemeanor charge of resisting and obstructing officers following an incident that began outside a fast-food restaurant and ended at the Nez Perce County Jail.
According to the police report, officers were first called to the Jack-in-the-Box at 1903 Main Street around 10:10 p.m. on May 30 after a woman reported a shirtless man walking in the road and “acting crazy.” The man, later identified as Damon, reportedly sprinted away when first approached by officers but was not immediately detained.
Officers remained in the area due to concerns about Damon’s erratic behavior and the potential for him to be struck by a vehicle. Later, Damon was seen inside a fenced patio area at the nearby Inn America hotel, allegedly holding containers of orange juice he had not previously possessed. Witnesses later confirmed he was not authorized to have the items, and police suspected a theft had occurred.
As officers approached, Damon reportedly threw one container at a police vehicle and then another at an officer, splashing the juice “all over” the officer. The officer attempted to arrest Damon, who fled but fell on the sidewalk. While trying to place him in custody, Damon allegedly kicked at the officer’s arms and continued to resist by tucking his arms under his body.
Additional officers assisted in securing Damon, who continued resisting and attempting to kick officers even after being handcuffed and searched. He was eventually transported to jail, during which he allegedly repeatedly kicked the patrol car’s door and seat.
Once at the Nez Perce County Jail, Damon was placed in a safety cell due to his behavior. Officers documented several scrapes on his body, which they attributed to his fall during the pursuit.
Hotel staff confirmed that Damon was not permitted on the premises and signed a trespass notice against him. Photos of the scene and damaged property were taken by officers. Orange juice reportedly soaked the officer’s uniform, duty gear, and patrol vehicle interior.
Damon has been charged with felony battery on a law enforcement officer and misdemeanor resisting and obstructing an officer. Damon appeared in court on Monday. Bond was set at $5,000.
