Temporary Restraining Order Issued in Kohberger Case Public Records Release

MOSCOW, ID – A judge has issued a temporary restraining order preventing the release of certain public records related to the Bryan Kohberger case following a petition filed earlier this month.

According to the City of Moscow, the petition was submitted to the Latah County District Court on August 12 on behalf of Karen Laramie, the mother of Maddison Mogen, one of the four University of Idaho students killed in November 2022. The request sought to halt further releases of sensitive materials after the city had recently provided redacted crime scene photos through a public records request.

On August 15, Judge Marshall of the Idaho Second District Court granted the restraining order, blocking the release of any images, audio, or video showing the inside of Mogen’s bedroom until a hearing on a preliminary injunction can be held. While the judge determined that much of the previously released content did not amount to an invasion of privacy, he ruled that unreleased material — including certain bodycam footage — could cross that line.

Although the order specifically covers Mogen’s bedroom, the City of Moscow announced it will suspend releasing any additional photographs or video from any of the victims’ bedrooms until the court provides further guidance.

The case remains under review in Latah County District Court.
