BOISE, ID – A report released this week by the Idaho Family Policy Center claims that a majority of Idaho public school districts are not complying with a state law restricting classroom instruction on sexual orientation and gender identity.
The 2025 law, House Bill 352, requires all public schools to adopt policies prohibiting instruction on those topics if it is not age-appropriate for students. The center said it submitted public records requests to every school district in the state and found that at least 66 districts had no policies in place meeting the law’s requirements.
According to the report, only 38.3 percent of districts were in compliance as of late September. Four districts had policies fully prohibiting instruction on sexual orientation and gender identity in all grades, while two limited instruction in certain grade levels. Another 23 districts allowed age-appropriate instruction under state standards.
The group argues that further legislative action is needed and recommends empowering the Idaho Attorney General and Superintendent of Public Instruction to enforce the law, prohibiting gender instruction outright, and withholding state funding from districts that do not comply.
House Bill 352 was signed into law by Gov. Brad Little on March 31. Supporters said it was intended to reinforce parental rights and ensure controversial topics are addressed at home rather than in classrooms.
