LEWISTON, ID — The Idaho Department of Environmental Quality (DEQ) is asking for public comment on a proposed settlement with Kenaston Corporation over stormwater permit violations at the company’s Northwest Fourslide construction site in Lewiston.
According to DEQ, the agency alleges that on January 25, 2024, Kenaston Corporation did not comply with all applicable conditions of its Idaho Pollutant Discharge Elimination System (IPDES) 2022 Construction General Permit for Discharge Activities (Permit No. IDR10C0RW). The permit governs how construction sites manage stormwater and other discharges to protect nearby waterways.
DEQ prepared an Expedited Settlement Agreement and Consent Order directing the company to resolve the violations and either pay a civil penalty or request a compliance conference. The agency says Kenaston Corporation has since resolved the violations, paid the full civil penalty of $1,725, and signed the Consent Order.
In accordance with Idaho Code 39-108(9) and IDAPA 58.01.25.500.04, DEQ is now publishing the proposed settlement action for public review and comment. The document is available on DEQ’s website and at the agency’s State Office at 1410 North Hilton Street in Boise.
Written comments will be accepted through December 15, 2025, at 5 p.m. MST. Comments may be submitted electronically via DEQ’s website or by mail or email to the agency, referencing the Kenaston Corporation settlement. DEQ noted that the settlement may be amended or adjusted in the future, and additional public comment opportunities could be provided if that occurs.
