Lewiston Man Charged with Felony Battery on Police Officer

LEWISTON, ID – A 21-year-old man is facing a felony charge following an incident late Friday night near a Lewiston bar, according to a probable cause affidavit filed in Nez Perce County District Court.

Zachary J. Herzog, of Lewiston, is charged with one count of battery upon certain personnel, a felony . The charge alleges battery against a law enforcement officer.

According to the affidavit, Lewiston Police responded around 11:33 p.m. on February 21 to a report of a citizen dispute near the Wrangler Bar on 21st Street. The report indicated individuals were in the street and that one person had thrown a garbage can.

Officers located a man identified as Herzog near the intersection of 9th Avenue and 8th Avenue Boulevard. Court documents state officers attempted to detain him and that he was placed in handcuffs. The affidavit alleges Herzog actively resisted arrest by pulling away, kicking his legs, and yelling at officers.

While conducting a search incident to arrest, an officer reported that Herzog grabbed and squeezed his arm. The affidavit states the officer ordered Herzog multiple times to release his grip. After briefly letting go, Herzog allegedly grabbed the officer’s arm again and squeezed it, according to the report. A supervising corporal reportedly assisted in removing Herzog’s hand.

The officer later reported bruising to his arm. Body camera footage and photographs of the injury are listed as evidence in the case.

Herzog was arrested and booked into the Nez Perce County Jail.  He is expected to make his initial court appearance on Monday afternoon.
