New Law Could Restrict Overnight Camping on Idaho Capitol Mall

BOISE, ID – The Idaho Legislature has passed the final version of House Bill 603, which now awaits the signature of Governor Brad Little to become law.

The bill, which passed the Idaho Senate on Tuesday following approval in the House on February 24, revises rules governing the Capitol Mall and other state-owned properties, including prohibiting overnight camping while allowing temporary side-free canopies for rain or snow protection.

“Any symbolic tents or other enclosed structures shall be removed from 9:00 p.m. local time to 6:00 a.m. local time, unless otherwise provided for in any applicable rules promulgated by the department of administration,” reads the bill.

HB 603 also clarifies procedures for the disposition of property left unattended or in violation of state rules, and updates management authority for multiagency state facilities. The Department of Administration will have exclusive control of Capitol Mall properties, with law enforcement responsibilities vested in the Idaho State Police, in coordination with Ada County and the City of Boise.

The legislation includes technical corrections, provides for enforcement of rules, and declares an emergency, meaning it will take effect immediately upon the governor’s signature. Supporters say the bill streamlines management of state properties and ensures clear rules for public use, while maintaining security and proper oversight.
