Man Charged With Felony Forgery After Allegedly Using Fake $100 Bills at Lewiston Restaurant

LEWISTON, ID – A Clarkston man is facing a felony charge after Lewiston police say counterfeit “movie prop” $100 bills were used during a late-night transaction at a Lewiston restaurant.

According to court documents, Gary D. Akers, 60, was arrested early Wednesday morning and charged with passing fictitious bills.

Court documents state officers were dispatched shortly after 12:35 a.m. on Feb. 11 to Denny’s on Nez Perce Grade following a report that individuals were attempting to use fake $100 bills.

An assistant manager told police a partially torn $100 bill had been used during a transaction. The affidavit states the bill contained the phrases “movie prop use only” and “not legal tender.”

A receipt included in the report showed a purchase of multiple food items totaling just over $52, with $47.90 in change reportedly issued from a $100 bill.

Police made contact with a female, who was described as having paid for the food. According to the affidavit, the woman told officers she received the bill from Akers to pay the bill and was expected to return the change to him. The report says the woman denied knowing the bill was fake. The affidavit also states the officer believed she appeared intoxicated at the time.

According to the affidavit, Akers denied knowingly passing fake currency before he was placed under arrest.

During a search, officers reported locating eight additional prop-style $100 bills on Akers’ person.

Prosecutors allege Akers passed two fictitious bills to another person in his party with the intent that they be used to pay for the meal. The affidavit states investigators believe the act was done knowingly and with intent to defraud the business.

Akers was booked into the Nez Perce County Jail. He is expected to make his initial court appearance on Wednesday afternoon.
