New Law Makes Tribal Warrants Enforceable by Washington State Authorities

SEATTLE, WA – A new Washington state law that took effect today allows tribal court warrants to be recognized and enforced by nontribal law enforcement agencies across the state, strengthening cooperation between tribal and state jurisdictions.

House Bill 1829, sponsored by Rep. Debra Lekanoff (D-Anacortes), updates the Tribal Warrants Act first passed in 2024. The law gives local and state law enforcement officers the authority to arrest individuals subject to tribal court warrants and present them before a local superior court for return to the appropriate tribal jurisdiction.

Attorney General Nick Brown praised the measure, saying, “This new law is an example of the collaborative work between the state, counties, and tribes to uphold justice and public safety. This new legal process supports tribal sovereignty, empowers local law enforcement and courts, and will bring justice to tribes across the state.”

Lekanoff called the legislation a critical step in ensuring equity. “The Tribal Warrants Act is more than legislation — it is a promise that no matter where you live or who governs your community, you deserve justice, dignity, and protection,” she said.

Under the new law, tribes that meet specific criteria—including compliance with the federal Tribal Law and Order Act and provisions ensuring defendants’ rights to counsel—can apply for certification. Certified tribes must also document public access to criminal laws and procedures and confirm that tribal judges are licensed by the state bar.

Once certified, tribal warrants will receive the same treatment as state warrants. Tribes that do not obtain certification must continue to submit extradition requests, which are subject to judicial review but do not carry the same authority as state warrants.

The Washington Attorney General’s Office will manage the certification process and maintain a public list of certified tribes.
