LEWISTON, ID – A Lewiston woman faces two felony charges after police say she entered another woman’s home without permission, used her belongings, and made a threatening statement during her arrest, according to court documents filed in Nez Perce County.
Officers responded on Nov. 25 after the resident reported returning home to find a woman inside who did not belong there and appeared to be under the influence. When police arrived, they contacted Melissa McAtee, who was inside the residence watching television and holding items the resident said were hers.
According to court documents, McAtee allegedly told officers she believed the home was hers and claimed she had taken a shower, eaten cereal, read a book, and gathered cigarettes and gloves—items the resident reported missing. Officers noted in their report that McAtee appeared impaired and made comments that did not seem logical.
After speaking with the resident and a property manager, officers arrested McAtee on suspicion of burglary under Idaho Code 18-1401.
As she was being escorted to a patrol vehicle, McAtee is alleged to have turned toward the resident and remarked, “You’re gonna be sorry for that one,” according to the affidavit. The officer viewed the comment as a threatening statement directed at a witness. Based on that exchange, McAtee was also booked on a felony charge of intimidating a witness under Idaho Code 18-2604(3).
Police collected cigarettes, gloves, and other belongings the resident identified as hers. Body camera footage, in-car video, photographs, and witness statements were listed as evidence in the case, according to court filings.
McAtee was booked into the Nez Perce County Jail. A judge reviewed the probable cause affidavit on Nov. 26 and allowed the case to proceed.
The case remains under review by the Nez Perce County Prosecutor’s Office.
