COEUR D’ALENE, ID — A Coeur d’Alene man will serve time in prison after being convicted of felony Video Voyeurism and misdemeanor Sexual Battery in connection to an incident that occurred in January 2024.
According to the Kootenai County Prosecuting Attorney’s Office, 20-year-old Dexter Ray Lumen Tondu was sentenced on June 18, 2024, by District Judge John Mitchell. The charges stem from an incident on January 2, 2024, when a female friend, who had stayed overnight at Tondu’s residence, awoke to find Tondu lifting her shirt, taking photos of her breasts, and digitally penetrating her without consent.
Video Voyeurism carries a maximum penalty of five years in prison, while Sexual Battery is punishable by up to one year in jail. The prosecution recommended a five-year prison term with parole eligibility after four years for the felony charge and a suspended one-year jail sentence for the misdemeanor, to run consecutively.
Judge Mitchell opted to retain jurisdiction, placing Tondu on a rider—a sentencing option in Idaho allowing the Department of Corrections to provide treatment and evaluation before the court makes a final decision on incarceration or probation.
Tondu returned to court on May 1, 2025, for a review hearing presided over by District Judge John Cafferty, following Judge Mitchell’s retirement. Despite the Department of Corrections recommending probation, citing treatment during the rider period, the court noted disciplinary issues and sided with the prosecution’s recommendation to keep Tondu in DOC custody for the remainder of his sentence, with parole eligibility after four years.
