Nez Perce County jury returns guilty verdict in Lewiston attempted strangulation case

LEWISTON, ID — A Lewiston man has been found guilty of felony attempted strangulation following a jury trial in Nez Perce County.

According to the Nez Perce County Prosecutor’s Office, Joseph A. Witherup, 46, of Lewiston, was convicted by a jury on March 3, 2026, after a one-day trial.

Court information released by prosecutors states the case stems from an incident on September 20, 2025, when the Lewiston Police Department responded to a 911 call reporting an alleged assault at an apartment. Investigators alleged that Witherup attacked his ex-girlfriend during the incident.

Authorities said the suspect allegedly fled the scene but was later arrested a few blocks away.

Following the conviction, Witherup now faces a potential sentence of up to 15 years in prison and/or a fine of up to $50,000, according to the prosecutor’s office. Sentencing is scheduled for April 29, 2026.

Nez Perce County Prosecutor Justin Coleman noted in a statement that attempted strangulation is considered a serious form of violence and is often associated with increased risk of future harm in domestic violence situations.

Coleman also credited Deputy Prosecutor Kali Jo Parker, the Lewiston Police Department, and the victim for their roles in the case.
