TUMALO, OR– Twelve Toy Australian Shepherds are now in the care of the Humane Society of Central Oregon (HSCO) after being removed from a property on Tumalo Reservoir Road on Sunday, August 3, 2025.
According to the Deschutes County Sheriff’s Office, Bend Fire & Rescue responded to the property for a reported structure fire. While on scene, firefighters observed multiple dogs living in unsanitary conditions and contacted law enforcement.
Deputy Benn Smith located the animals inside the home and basement, where he found significant accumulations of animal waste. The dogs’ owner, identified as 38-year-old David De Persio, voluntarily surrendered all 12 animals.
De Persio was cited for second-degree animal neglect. The charge has been elevated to a Class C felony under Oregon law because more than 11 animals were involved.
HSCO reports the surrendered dogs are generally healthy but under-socialized. They have received veterinary examinations, age-appropriate vaccinations, and will be spayed or neutered before adoption. Shelter staff say the dogs will do best in homes where they can receive extra attention, training, and patience.

The sheriff’s office thanked Bend Fire & Rescue for reporting the conditions, Deputy Smith for his response, and HSCO for their assistance. Officials encouraged community members to consider adoption to give the animals a second chance.
